Article 3. Scope

  1. These terms apply to every offer made by WELLmark B.V. to consumers and to every distance contract concluded through the online store.
  2. Before the agreement is concluded, these terms are made available in a manner that allows the consumer to access and save them easily.
  3. Separate terms may apply to business customers, wholesale, private label and other customised business agreements.

Article 4. Offer and agreement

  1. The offer contains as complete and accurate a description as reasonably possible of the products, price, shipping costs and other relevant conditions.
  2. Images are intended to represent the products accurately. Handmade products, natural materials and batch production may show minor differences in colour, texture or finish.
  3. The agreement is concluded after the consumer places the order, provides the required information and completes payment through checkout, after which WELLmark B.V. confirms the order electronically.
  4. Obvious mistakes, typographical errors and evident pricing errors are not binding on WELLmark B.V.

Article 5. Prices and payment

  1. All consumer prices are shown including VAT. Any shipping costs are displayed clearly before the order is completed.
  2. Payment is due immediately using the payment methods made available at checkout.
  3. If payment is not completed successfully, WELLmark B.V. has no obligation to dispatch the order until payment has been received correctly.

Article 6. Delivery

  1. Orders placed and paid for on business days before 12:00 noon are generally dispatched the same business day, unless otherwise stated on the product page or at checkout.
  2. For the Netherlands and Belgium, the indicative delivery time is approximately 1 business day after dispatch. Delivery times to other countries depend on the destination and carrier.
  3. Delivery times are estimates. If delivery is delayed, the consumer will be informed as soon as reasonably possible. Statutory consumer rights remain unaffected.
  4. The risk of loss or damage passes to the consumer when the order is received by the consumer or a person designated by the consumer.

Article 7. Right of withdrawal

  1. For online purchases, the consumer generally has the right to withdraw from the agreement within 14 days after receiving the product, without giving a reason.
  2. After notifying WELLmark B.V. of the withdrawal, the consumer has a further 14 days to return the product.
  3. The consumer may inspect the product in the same way as would reasonably be possible in a physical store. WELLmark B.V. may deduct an amount for diminished value caused by handling beyond what is necessary to establish the nature and characteristics of the product.
  4. Withdrawal may be notified by email to info@wellmark.nl, stating the consumer's name and order number. Returns must be sent to: WELLmark B.V., Maaskade 37, 5347 KD Oss, The Netherlands.

Article 8. Return costs and refunds

  1. The direct cost of returning goods following a standard withdrawal is borne by the consumer.
  2. For a valid withdrawal, WELLmark B.V. refunds the payments received for the returned products and, when the entire order is withdrawn, the cost of the least expensive standard delivery offered. Additional costs for a more expensive delivery option are not refunded.
  3. Refunds are made no later than 14 days after WELLmark B.V. is informed of the withdrawal. WELLmark B.V. may withhold the refund until the goods have been received back.
  4. Refunds are made using the same payment method used for the original transaction unless otherwise agreed.

Article 9. Exceptions to the right of withdrawal

  1. The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised for a specific person or organisation, where permitted by law.
  2. For sealed goods that are not suitable for return due to health protection or hygiene reasons, the right of withdrawal ends once the seal has been broken after delivery.
  3. Returned goods should, where reasonably possible, be unused, undamaged and complete. Merely opening ordinary packaging does not automatically remove the right of withdrawal unless a statutory exception applies.

Article 10. Incorrect delivery, transport damage and defects

  1. If a product is delivered incorrectly, damaged or defective, the consumer should contact info@wellmark.nl as soon as reasonably possible, stating the order number and, where relevant, providing photographs.
  2. Where WELLmark B.V. is responsible for an incorrect delivery, transport damage or a defect, reasonable return costs are borne by WELLmark B.V.
  3. Consumers' statutory rights to goods that conform to the agreement remain fully applicable.

Article 11. Statutory guarantee and conformity

  1. WELLmark B.V. warrants that the supplied products conform to the agreement and to the reasonable expectations a consumer may have based on the product description, price and other information provided.
  2. No separate commercial guarantee period applies unless expressly stated for a product. This does not affect the consumer's statutory guarantee and conformity rights.

Article 12. Complaints

  1. Complaints may be submitted to info@wellmark.nl, stating the consumer's name, order number and a clear description of the complaint.
  2. WELLmark B.V. aims to respond substantively within 14 days of receiving a complaint. If more time is required, the consumer will receive an acknowledgement within that period together with an indication of the expected handling time.
  3. If the parties cannot resolve a dispute together, the consumer may use the legal dispute-resolution options available to them.

Article 13. Force majeure

  1. WELLmark B.V. is not liable for delay or non-performance caused by circumstances beyond its reasonable control, such as carrier disruption, government measures, natural disasters, war, strikes or serious supply-chain disruption.
  2. Statutory consumer rights that cannot lawfully be limited remain unaffected.

Article 14. Liability

  1. WELLmark B.V. is liable for damage to the extent required by applicable law. Any limitation in these terms applies only to the extent permitted by law.
  2. WELLmark B.V. is not liable for damage resulting from use contrary to instructions, warnings or the normal intended use of a product, unless applicable law provides otherwise.

Article 15. Governing law and disputes

  1. Agreements with WELLmark B.V. are governed by Dutch law.
  2. For consumers residing in another EU Member State, this choice of law does not deprive them of mandatory consumer protection available under the law of their country of habitual residence.
  3. Disputes are submitted to the court that has jurisdiction under applicable law unless the parties mutually agree on another legally permitted dispute-resolution method.

Article 16. Changes to these terms

  1. WELLmark B.V. may amend these terms. The terms applicable to an order are those in force when the order was placed.
  2. If any provision is found to be wholly or partly invalid, the remaining provisions remain in force.
